These Terms & Conditions ("Terms") govern your use of Fancydresscostume.in (the "Site") operated by Rita Barman, sole proprietor, trading as Fancy Dress Costume ("we", "us"). By using the Site, visiting our store, or placing an enquiry, rental, or purchase order, you agree to these Terms. If you do not agree, please do not use our services.

Fancy Dress Costume is a sole proprietorship operated from C-22, Second Floor, Surya Nagar, Ghaziabad, Uttar Pradesh 201011, India. GSTIN: 09BPJPB0780B1ZA. References to "we," "us," and "our" refer to the proprietor and her duly authorised representatives. References to "you" and "your" refer to the customer or person agreeing to these Terms.

1. Eligibility

To make a purchase or rental, you must be at least 18 years of age and capable of entering into a legally binding contract under Indian law. Our products are designed for children, but transactions are made by parents, guardians, school administrators, retailers, or other adults acting on behalf of children.

2. Account and accuracy

You are responsible for providing accurate and current contact information. We use your phone number as the primary identifier across all of our services. You must ensure that the phone number, address, and other details you share with us are correct.

If you are placing an order on behalf of a school or organization, you confirm that you are authorized to do so and to commit to these Terms on their behalf.

3. Rentals — what's included

A standard rental includes:

  • The costume and its core accessories (as listed in the product description)
  • A 24-hour rental period from time of pickup or delivery
  • Quality-checked, hygienic preparation

Some accessories (footwear, makeup, jewelry) may be sold separately and are not part of the standard rental unless stated.

4. Customer responsibilities during rental

When renting from us, you agree to:

  • Use the costume only for the intended purpose (events, performances, photo shoots, school functions)
  • Take reasonable care to keep the costume clean and undamaged
  • Not alter, dye, or modify the costume in any way
  • Not sub-rent or transfer the costume to anyone else
  • Return the costume on time and in the agreed condition
  • Inspect fit and condition at pickup/delivery and report any concerns immediately
  • Pay any damage, late, or non-return charges as per our Refund Policy

5. Pricing and payments

Prices on our website and in our store are in Indian Rupees (₹) and are exclusive of GST and other applicable taxes, which are added at the time of billing as per Indian law. Pricing for individual costumes is determined per our internal pricing rules and may vary based on costume type, condition, rental duration, and delivery zone.

We accept cash, UPI, and bank transfer. Online payments via Razorpay are being added soon. Payment for rentals includes the rental fee plus security deposit at the time of pickup or delivery. Final charges (including any late fees, damage charges, or extra-day rentals) are settled at the time of return.

6. Cancellations and refunds

Cancellation timing, late return rules, damage assessments, and refund timelines are governed by our Refund Policy, which forms part of these Terms by reference.

8. Safety, hygiene, fabrics, and photo consent

Safety, hygiene, fabric / material disclosures, photo / video consent, and CCTV monitoring are governed by our Safety & Care Guide, which forms part of these Terms by reference. Please read it carefully — it covers your responsibilities and ours when it comes to costume use, allergies, and store visits.

9. School and bulk orders

Bulk orders for schools, institutions, or events follow separate terms agreed in writing at the time of order. Standard policies (cancellation timing, refund windows, delivery rules) may not apply to bulk orders.

Schools and large organizations should contact us directly for a bulk quotation. Individual student information is collected by our field measurement team in person, never through the website.

10. Wholesale orders

Wholesale customers (resellers, distributors, retailers) are subject to separate wholesale terms, including minimum order quantities, payment terms, and pricing. Wholesale pricing is shared only with verified business customers and is not available to retail customers.

11. Franchise enquiries

Franchise enquiries submitted through our website are reviewed individually. Submitting an enquiry does not create any agreement. All franchise arrangements are governed by separate franchise agreements signed in writing.

12. Intellectual property

All content on our website — text, images, logos, designs, the "Fancydresscostume.in" name and brand — is owned by us or used with permission. You may not copy, reproduce, distribute, or use our content for commercial purposes without our written permission.

13. Use of website

When using our website, you agree not to:

  • Submit false, misleading, or fraudulent information
  • Attempt to access areas of the site you are not authorized to access
  • Interfere with the security or operation of the site
  • Use the site for any unlawful purpose
  • Reproduce or scrape content without permission

14. Acknowledgment of condition at receipt

At the time of pickup (in-store) or delivery (online), you are responsible for inspecting the costume for any pre-existing damage, defects, missing accessories, or sizing issues. You must report any concerns to us within 2 hours of pickup or delivery, in writing via WhatsApp, email, or in person.

After this 2-hour window, the costume is considered accepted in the condition shown to you, and any later-discovered damage or issues will be assessed against your security deposit at return. Photographs and condition notes taken at pickup or delivery, and shared with you via WhatsApp, serve as the official record of the costume's condition at handover.

15. No-cleaning rule

Please do not attempt to clean, wash, or dry-clean any costume or accessory yourself. This includes machine washing, hand washing, bleaching, tumble drying, ironing on direct heat, or using any cleaning agents, sprays, or stain removers.

Improper cleaning frequently damages costume fabrics, dyes, and embellishments — far more often than the original stain would have. We professionally clean every costume between rentals using methods appropriate to the fabric. If you accidentally stain or soil the costume, simply return it as-is and we will assess and clean it. If you attempt to clean the costume yourself and it is damaged as a result, the damage will be charged to you per our standard damage assessment process.

16. No food, drink, smoking, or strong substances while wearing

To preserve the quality of our costumes, you agree not to eat, drink (other than water), smoke, vape, or be in close proximity to strong-smelling substances (perfumes, cooking smoke, paint fumes, etc.) while wearing the costume. Stains, food spills, smoke odour, and similar damage caused by these activities are charged at our standard damage rates.

17. Loss, theft, or destruction during rental

During the rental period, the costume remains our property and is in your custody. If the costume is lost, stolen, destroyed, or rendered unusable while in your possession (including from theft from a vehicle, hotel room, event venue, or your home), you are responsible for the full replacement cost — equal to the costume's retail price.

If the loss is due to theft, please file a police complaint (FIR) and provide us a copy. While the FIR does not waive your liability for the replacement cost, it helps us with insurance and recordkeeping.

18. Color, size, and design approximations

All costume sizes shown on our website are approximate. Size charts are guidelines only — actual fit may vary by costume and brand. Colors and patterns shown in photographs may differ slightly from the actual costume due to monitor/screen calibration, lighting differences, and natural fabric variations. Minor differences from the photographic representation are not grounds for refund or cancellation, though we are always happy to suggest alternatives if a costume doesn't meet your expectations after delivery.

19. Pricing errors and our right to cancel

Despite our best efforts, occasional pricing errors, typographical mistakes, or technical glitches may occur on our website. We reserve the right to refuse or cancel any order arising from such errors, including after order confirmation has been sent. If your payment has been processed for a cancelled order, we will refund the full amount within 7 working days to the original payment method.

We are not obligated to honor a price displayed in error. Should we choose to honor a price as a goodwill gesture, this does not create any obligation to do so on future occasions.

20. Inventory and availability

Stock availability shown on our website is updated regularly but may not always reflect real-time inventory. A costume may show as available at the time of booking but may have been recently rented to another customer or withdrawn for cleaning, repair, or retirement. If we cannot fulfill a confirmed booking due to availability, we will offer you (a) the closest equivalent costume, (b) a different date, or (c) a full refund of any amounts paid. Our liability for unfulfilled bookings is limited to the refund of amounts paid.

21. Our right to cancel orders

We reserve the right to cancel or refuse any order at our reasonable discretion, including but not limited to situations where:

  • We suspect fraudulent or unauthorized payment
  • The customer has a history of repeated damage, late returns, or non-returns
  • The costume is unavailable or has been recalled
  • Information provided in the order is incomplete or inaccurate
  • The order appears to violate applicable laws or these Terms

In such cases, we will refund any amounts paid in full and notify you of the cancellation reason where appropriate.

22. Risk of loss during transit

For deliveries arranged by us in Delhi NCR, the risk of loss or damage transfers to you at the time the costume is handed over and accepted at your address. For courier-based shipments (when applicable in future), risk transfers when the costume is delivered to the courier carrier. Once accepted, you are responsible for the costume until it is returned to us in person or picked up by our team.

23. Right to refuse service

We reserve the right to refuse service, refuse rentals, decline future bookings, or terminate ongoing rentals to any customer who: repeatedly returns costumes damaged or late; engages in abusive or threatening behaviour toward our staff; provides false information; uses our services in violation of these Terms or applicable law; or is found to have used our costumes for unlawful or inappropriate purposes. Such refusal does not require advance notice, though we will provide notice where reasonable.

24. Account suspension and termination

We may suspend or terminate your account or access to our services at any time, with or without notice, if we believe you have breached these Terms, engaged in fraud, or pose a risk to our business, our staff, or other customers. Outstanding amounts owed to us at the time of termination remain payable. We may report fraudulent activity to law enforcement authorities.

25. Identification tags and SKU labels

Our costumes carry identification tags, SKU labels, sewn-in identifiers, or other tracking marks. You agree not to remove, deface, or destroy any such tags or labels. Removal, defacement, or destruction of identification marks results in a fee equal to 10% of the costume's retail price, in addition to any other damage charges that may apply. This requirement helps us maintain the lifecycle and quality records for each costume.

26. Marketing communications and email opt-out

By providing your contact details, you consent to receive transactional communications from us related to your bookings, deliveries, and inquiries. These transactional communications are necessary to fulfill our service to you and cannot be opted out of while you have an active booking or account.

Promotional and marketing communications (newsletters, offers, new product announcements) are sent only with your consent. You may opt out of marketing communications at any time by replying "STOP" to our messages, clicking unsubscribe in any email, or contacting us. Opting out of marketing does not affect transactional communications related to your active orders.

27. Promotional codes and discounts

From time to time we may offer promotional codes, discount coupons, referral credits, or special offers. Use of these is subject to:

  • One promotional code per order, unless explicitly stated otherwise
  • Validity periods, minimum order values, and category restrictions as specified in the offer
  • No cash redemption value — promotional credits are usable only against eligible orders
  • Non-transferability between accounts unless explicitly permitted

We reserve the right to refuse, suspend, or cancel promotional codes if we suspect abuse, fraud, or violation of the offer's terms. We may modify or end any promotion at any time without prior notice.

28. Site availability — "as is, as available"

Our website is provided on an "as is" and "as available" basis. We do not guarantee that the website will be available at all times, free from errors, uninterrupted, secure against all threats, or compatible with every device or browser. We may suspend, modify, or discontinue any feature of the website at any time without notice. Your use of the website is at your own risk, and you should keep your own backups of any information you submit to us.

29. Third-party links and services

Our website may contain links to third-party websites and services (such as Razorpay for payments, Google Maps for directions, social media platforms, and others). We provide these links for your convenience but are not responsible for the content, privacy practices, security, or availability of third-party sites. Your interactions with third-party sites are governed by their own terms and policies, and we recommend reviewing them before use.

30. Product safety and quality standards

We take reasonable care to ensure that costumes supplied for rental or sale are visually inspected, in working order, and fit for the typical use of fancy dress costumes. Where applicable, we comply with Indian regulations and standards governing children's apparel, textiles, and consumer goods.

We do not represent that our costumes are tested to specific international toy-safety standards (such as EN71, ASTM F963, or REACH) unless explicitly stated for a particular product. 31. Cosmetics, makeup, and chemical products

If we offer cosmetics, makeup, body paint, or other chemical products as part of a costume or accessory range (now or in future), ingredient lists and usage warnings will be provided at the time of sale. Such products are sold for one-time, single-person use only and are not part of any rental return. Customers with known sensitivities should review ingredients before use and perform a patch test on a small skin area at least 24 hours before the event.

32. Notices and formal communications

Any notice, demand, or formal communication required to be given under these Terms must be sent:

  • To us: by email to fancydressncr@gmail.com (with a copy by registered post to C-22, Second Floor, Surya Nagar, Ghaziabad, Uttar Pradesh, India for legal proceedings).
  • To you: by email to the address you have provided to us, by SMS or WhatsApp to your registered phone number, or by post to your registered address. Communications sent to the contact details you have provided are deemed received within 48 hours of dispatch.

It is your responsibility to keep your contact details current. We are not responsible for communications failing to reach you due to outdated contact information you have provided.

33. Survival

Provisions of these Terms that by their nature should survive termination — including but not limited to limitation of liability, customer indemnity, intellectual property, dispute resolution, governing law, and notices — will continue to apply after the termination of any rental, purchase, or other agreement between us.

34. Limitation of liability

We provide our products and services on an "as is" basis. While we strive for the highest quality, we cannot guarantee that costumes will be available at all times, that delivery will always be on schedule, or that the website will be free from errors or interruptions.

To the fullest extent permitted by law, our maximum liability to you for any claim related to a transaction is limited to the amount you paid for that specific transaction. We are not liable for indirect, incidental, special, punitive, or consequential losses (such as missed events, lost opportunities, lost revenue, or emotional distress) arising from the use of our products or services.

Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under Indian law, including liability for gross negligence, fraud, or wilful misconduct on our part.

35. Customer indemnity

You agree to indemnify and hold us harmless from any claim, loss, damage, or expense (including reasonable legal fees) arising from your misuse of our products or services, your breach of these Terms, your violation of applicable laws, or any negligence or wilful misconduct by you or anyone using our costumes through your booking. This includes situations where damage to a costume causes loss of further rental income, where misuse of a costume causes injury to third parties, or where false information you provide causes us to incur costs.

36. Force majeure

We are not responsible for failures to deliver or perform services caused by events beyond our reasonable control. These include, without limitation:

  • Natural disasters (floods, earthquakes, severe weather)
  • Government actions, lockdowns, curfews, regulatory changes
  • Strikes, riots, civil unrest, terrorist incidents
  • Transport disruptions, fuel shortages, vehicle breakdowns
  • Pandemics or public health emergencies
  • Internet outages, power failures, payment gateway downtime
  • Vendor or supply chain failures beyond our control
  • Acts of war or sabotage

In such cases, we will work fairly with you to reschedule, refund, or otherwise resolve the situation reasonably.

37. Time limit on claims

Any claim or cause of action arising out of your use of our products or services must be filed within one (1) year after the incident giving rise to the claim, or it is permanently barred. This is in addition to any shorter dispute window stated in our other policies.

38. Individual claims only

All claims must be brought individually. You may not bring a claim as a representative of a class, on behalf of other customers, or in a consolidated proceeding combining multiple customers' claims, except where required by Indian law.

39. Dispute resolution — direct contact, mediation, arbitration, then court

Most disputes are misunderstandings that can be resolved through honest conversation. Before initiating any formal legal proceeding, you agree to follow this four-step process:

  1. Step 1 — Direct contact. Send us written notice of your concern via email to fancydressncr@gmail.com or WhatsApp to +91 9871278984. Describe what happened, what you'd like resolved, and how we can reach you. We will respond within 30 days and engage in good faith to resolve the issue directly.
  2. Step 2 — Mediation. If the issue is not resolved within 30 days of direct contact, the dispute will be referred to mediation by a mutually agreed mediator in Ghaziabad, Uttar Pradesh. Mediation is informal, low-cost, and confidential. Each party bears its own costs of mediation, with the mediator's fee shared equally.
  3. Step 3 — Arbitration. If mediation fails to resolve the dispute within 60 days, the dispute will be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). Arbitration will be conducted by a sole arbitrator mutually agreed by the parties, or failing agreement, appointed under the Act. The seat of arbitration shall be Ghaziabad, Uttar Pradesh, and the language shall be English. The arbitral award shall be final and binding on both parties, subject to the limited grounds for challenge under Indian law.
  4. Step 4 — Court as last resort. Only after the above steps have been completed may you pursue formal legal action through the appropriate courts of competent jurisdiction at Ghaziabad, Uttar Pradesh.

Nothing in this section limits your rights under the Consumer Protection Act, 2019, or other consumer-protection laws of India. This process is intended to give us a fair chance to resolve your concern through faster, cheaper means before formal proceedings — not to deny you any legal remedy. Where Indian law gives consumers an unrestricted right to approach Consumer Forums directly, that right is preserved.

40. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

41. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. The unenforceability of one part does not affect the validity of the rest.

42. No waiver

Our failure to enforce any right or provision of these Terms on any occasion will not be considered a waiver of that right or provision in the future. Any waiver must be in writing and signed by us.

43. Entire agreement

These Terms, together with our Refund Policy, Delivery & Pickup Policy, Safety & Care Guide, and Privacy Policy, constitute the entire agreement between you and us regarding your use of our services. They supersede any prior agreements, communications, or understandings on the same subject matter.

44. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when changes were made. For significant changes, we will notify you via email, SMS, or a prominent notice on our website. Your continued use of our services after changes are posted means you accept the updated Terms. If you do not agree to the changes, your only option is to stop using our services and request closure of your account.

45. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the dispute resolution process in Section 39, any disputes arising from your use of our services or these Terms will be subject to the exclusive jurisdiction of the courts at Ghaziabad, Uttar Pradesh.
